Ted Cruz’s questioning of Ketanji Brown Jackson was “absurd,” says his former teacher Alan Dershowitz

Ted Cruz’s former law teacher Alan Dershowitz has called the Texas senator’s questioning of Supreme Court nominee Judge Ketanji Brown Jackson “absurd”.

At Ms. Jackson’s confirmation hearing on Wednesday, Mr. Cruz asked how she could determine if she could challenge a gender rule since she could not define what a woman was, adding what would happen if he so simply defined his race like a gender change would change.

“Tell me, does the same principle apply to other protected characteristics? For example, I’m a Hispanic male. Could I decide that I’m an Asian male?” asked Mr. Cruz.

“Would I have the ability to be an Asian male and challenge Harvard’s discrimination for making that choice?”

Ms Jackson said she would decide to stand in such a transracial case by listening to the arguments of the parties, taking into account precedents and the constitutional principles involved.

However, Mr Cruz’s former law professor said the question was “absurd”.

“I hope he didn’t learn them from me, he was my student where he said, ‘If a man has the right to choose to be a woman, then as a Latino I will have the right to choose to be a woman to decide to be Asian? ‘” Mr Dershowitz said on a Rumble livestream.

“No, no you don’t, you can’t transform into someone who’s Asian. You can marry someone who is Asian, live an Asian life and be part of Asian culture. But no, you can’t.”

He added that people could convert just as a Catholic converts to Judaism, which is both a race and a religion. Or the other way around. But there are certain things, like being Hispanic or Asian, that you can’t change.

“We used to think that gender was one of them. It turns out it isn’t. Turns out you can change gender,” he said.

Mr. Dershowitz taught Mr. Cruz at Harvard Law School, and the case that Mr. Cruz cited during his questioning was a pending allegation that Harvard University’s affirmative action guidelines violate the rights of Asians.

Both double-filed after the confirmation hearing, with the student going to Fox News and the teacher Newsmax to plead their case.

“She is probably the first Supreme Court nominee in the history of our country who is unable to answer the question of what a woman is,” Mr. Cruz said on Fox News after Jackson told the hearing she am not a biologist and therefore cannot. t define what a woman is.

Mr Dershowitz said Mr Cruz, previously described as one of the best students he has ever had, told Newsmax that he does not “stand out from the crowd” by comparing transgender people to transracial people.
